Topic: Advice Please - anything much appreciated

I live in a housing association property and have done for the last 5 years.  5 years of sheer hell.  From successive tenants in the flat above me, creating havoc through loud music, fighting, stamping and running across the floor, regular late night into the small hours noise re the above, and on and on.  The recent incumbent has only been in here for a few months.  Because of her late night noise, I now sleep in my bathroom - yes, that's right, the bathroom.  My landlord is aware of this.  She sleeps throughout the day, and the night time is her day if you like.  I have recorded noise disturbance on diary sheets for the social landlord, and each time her housing officer (the flat above me is managed by a housing officer different to mine, and this tenant also has to have her support worker present) calls to speak to her about my diary recordings, she denies everything, states she was away from the flat at the time, and is backed up by her family and friends.  I then get contacted by my landlord to say that they believe her and that's case closed.  I am constantly on edge, exhausted, depressed.  Could anyone confirm if possible, is it a reasonable option to do the following: go to Shelter for housing advice on this situation, contact my MP, prime minister, and housing minister?  I am at a loss, as the landlord is siding with her, and believes everything she tells them.  They even praised her for making an effort to keep noise to a minimum.  I can't begin to tell you how that one made me feel.  Thank you for any help here.  I have read the other posts, and I so sympathise.  This is an epidemic, that has been allowed to continue re social housing; surely now something must be done to help the decent majority.

OK. Ring E H tomorrow....register your complaint.  She'l get a letter. Also advise both your and her social landlords...tis polite.

KEEP COPIES....of everything including all logs/details.

Your NOT alone with this anymore.

It is not unusual for perpertrators to have false witness's backing them.  It is not unusual for Housing officers to be caught in the spell of "butter dos'nt melt".

It is enough God Knows to feel like your the bad person, to be made to feel your in the wrong, to feel there's no-one there for you.....

I promise you that TRUTH is your strongest weapon.....


I too spent time sleeping in my bathroom....and in a garage once.....I'm "lucky" in that I can sleep in my lounge, when and if I'm allowed....hav'nt had my bedroom since New Year's.



Tomorrow at noon I have mediation with my "butter dos'nt melt" person....but I TRULY believe that TRUTH will out....

I think this comes back to the old question of evidence.  In my honest opinion, in such a case as this, written evidence in diary format is not enough.  You need something more tangible such as a audio video recording (I havent heard of the Matron System before).

Beg, borrow or steal a video camera of some sort, set it up and start recording the noise on one of her nights.  If possible copy the video evidence to computer and burn to CD - then dump the CD on her housing officers desk and simply tell her "theres the evidence and if you dont do something about it within the next 48 hrs I am going to sue the council for breach of my human rights".  Alternatively, if you can dump it to computer just e-mail it to the HO.

The words sue, breach and human rights (along with the evidence) should be enough to get the ball rolling.

After 5 years I would now be well past the stage of killing someone so I can only applaud your resilience.  But perhaps the time has now come to take the gloves off and start fighting back with every trick in the (admittedly very slim noisy neighbours) book.

I raised the matter to Pandora.  I did so because we have had an influx of people recently all trying to sell something to make some money off others misery.  Look through some of the threads and you will see everything from artificial excrement to TV shows and it was all starting to detract from what Laurence was trying to achieve when he set this site up.

When a new user comes on and starts advising such and such a product with no other explanation it does tend to make me wary.  However, having now seen your post above, I can certainly understand the suggestion.

So welcome to the forum.  Hopefully you will be a wealth of knowledge to those of us who are relatively new to this world of misery.

Yesterday I was informed by my EH case officer that even though I have collected my own evidence on my camcorder, it would not stand up in court as its not impartial. it has to be their specific equipment. its ok I guess to produce it as evidence that a noise is occuring but legally from what he was saying...it doesnt mean a thing, can anyone elaborate on this please?

I have made recordings of my noise disturbance, in my case dogs, and the levels of barking howling etc can be heard well above my tv or music...almost as if they were right next to me. hopefully they will take this on board in the meeting.  smile
