Topic: How quickly can I move flat? Please help!

I desperately need some help. My husband and I are fist time buyers and don’t have a huge income so we were delighted when we bought our flat, everything was great and we were starting to settle in. About 2 months ago students moved into flat above us and started having parties at the weekend. On top of that the only have the original floor boards so we could hear their every move. I know everyone is entitled to a party now and again but these students have started having parties during the week. I found myself lying wide awake at night with ear plugs in, I’m getting anxious and I’m absolutely exhausted at work. The only time I get a good nights sleep is when I go to my in laws at the weekend.

These students had a loud party on Sunday till about 3am which I let slide. However last night (Tuesday) they had another party. I went to ask them to turn the music down politely and explained that I had to go work early. The French student was apologetic however they just completely ignored me and carried on with their party. My husband then went up to knock on their door, they just ignored so my husband just left them to it. Not 10 minutes later the noise got louder and they were singing away and stamping their feet. By this time we were clearly annoyed at how inconsiderate they are and my husband again went back to speak to them, again these students just ignored him and sang even louder. My husband persisted outside their door until someone answered and by this point he was clearly upset and ended up shouting at them when it could have been prevented if they’d just been decent about it. I remember when I was a student I would have been horrified if someone complained about me. These students just didn’t care. The noise has been ongoing since they moved in but now i feel like i can't relax at home, and just dread the thought of going back there.

I’m now wondering if we can move flat so early? We only got our mortgage in September. I’m going to contact the factors to see if I can get the details of their landlord.
I feel totally cheated by the woman who sold us this flat, she said she had no problems with noise at all. I hope the problem doesn’t escalate into something worse? I’m absolutely desperate, any advise would be much appreciated

Have you considered using the letter on the main site (bottom of this page: http://www.noisyneighbours.net/approach … eighbours/)? That might get the willies up them and it shows that your intentions are serious.

You shouldn't have to move out of your home to avoid noisy neighbours - at least not without a fight!

Thanks Edward, i'll give it a go. Spoke to the factors and they won't give me the landord details but can write to them on my behalf. So we'll see how it goes...

I didn't use that letter because I wasn't aware of this site at the time, but I did put a note through my noisy neighbours' door (have since moved) saying that the noise was unacceptable and if it didn't stop I would contact the environmental wardens and/or the police.  It certainly did the trick!

You have my every sympathy, a friend of mine is going through the same thing, you need to contact your Mortgage Lender to see if you can transfer the mortgage to another property, redemption at this early stage may cost you a penalty so if you cannot afford to redeem then see if you can rent the flat out.
You need to contact the Freeholder (ie the Landlord) of the block as a whole or the Management Company, the Lease will contain provisions for the Landlord to enforce the conditions of the Lease one of which will be no noise between certain hours of the day and night. If it is a property with just two flats then you will be Landlord for the upper flat and will have the right to enforce the conditions of the Lease on the owner of the flat above you.
A good Landlord will take a dim view of breach of the conditions of the Lease and most Lease's contain a forfeiture clause will allows the Landlord to take possession of the property for continuous breach.
I dont see why these people should force you out of your home!

Thanks Sam, that's great advise and i'm sorry your friends are going through the same thing but at least i know there are others out there in similar situations as us. it's actually a tenement flat we live in, there is a huge redemption penalty as we only moved in 3 months ago so we can't afford to move for at least 2 years. Will definately consider moving elsewhere, renting out and absorbing any costs.

I remember asking the previous owner what the sound proofing was like and she said is was good and she never heard any of he neighbours!! I feel totally cheated that she would lie and say anything just to get the sale

it's such a pity when really inconsiderate thoughtless people don't have any regards for any one but themselves

Hi, i feel your pain i had that  few years ago but the students got evicted as the landlords brother was staying locally and they were spray painting out side the house..... that was the last straw.

Quick question i have had issues with the guy who lives upstairs with his music.  I am pretty sure he rents but i have thought about contacting his land lord if things persist.  Do you know how to go about finding the details of the landlord ?

All landlords are suposed to be registered with the council so you could check you council website. (Our landlord above us hasn't registered though!) You could always ask your factors to write a letter on your behalf, they won't give you the landlord details. I'm definately going to move in a couple of years, just need put up with it till then and in the meantime I'm hoping they'll move out soon.

Our noise problem has been on going ever since my first post. I've tried to knock on their door early in the evening before they get too drunk and they still ignore me and don't even bother to answer the door. We ended up calling the police at the weekend, not sure what happened though.
Our mortgage is fixed so we're tied to that flat for the next 5 years if we don't want to pay back a huge redemption cost.
We've decided that the best thing to do is to move out and rent our flat with the noisy neighbours upstairs, (feel sorry for putting tenants in there) but i just can't take it anymore. I just hate going home, i'm constantly tired and my work is suffering.
I just can't believe how inconsiderate people are. We were so excited to have bought our very own first flat that we could settle down in and make it our own and it's now been ruined...
