Topic: I need help!

Hi all,

I did post a note on here last year regarding the neighbours that live above me.

We own our ground floor flat, the one above is rented.

Landlord rents to 2 doctors, a live in babysitter and a young child.

The child and the babysitter never leave the flat EVER, and they have to be the noisiest/ ignorant people I have ever met in my life.

They let the child run wild from first thing in the morning, to sometimes early hours, as apparently the child doesnt need sleep in the day and likes to go to bed when the parents do.
There excuse for this was that as they are doctors they work funny hours and the child likes to be up when they are so they let her, good parenting hey?

I have taken my complaint to the council, which has been going on since about October,filled in all the noise sheets had a recording unit fitted for a week, which the council havent even bothered to listen to yet. Going back in during March as I dont think they will have picked up much, its like the tenants knew it was being installed - the quietest week we have ever had with them, its just typical!

Council lady has given me more monitoring sheets to fill in, not sure how thats going to help now.

This weekend was the worst weekend I have had since I moved in, they had lots of friends round, lots of kids running around all weekend, asian music blasting out, I just cant take it anymore, I dont understand people who behave this way knowing they are distressing someone already..

Im not a violent person but sometimes all I want to do is go upstairs and take my anger out on them, I cant help feeling this way. Please help! I need advice on how to cope....

I forgot to mention... my flat is currently for sale, and the council did mention that if/when we get a buyer it will show up that we have made a complaint about the flat above.

Does anyone know if I need to tell people when viewing the property straight away?

Also, if they move out before we find a buyer, do we not need to mention it?

if you dont declare the complaint, the new owners could sue you. best be up front. still think you have to declare even if they move out as could be a soundproofing issue but prob best to speak to a solicitor. and also record the noise esp loud music on a phone or camcorder and take it to council. they cant use it in court as eveidence but will prove the noise is there. I also take photos of my scummy neighbours letting their dog run around on communal grass and messing. to prove they allow it cos neighbour lies about it to council, making me look like am making it up

Ok thanks for the info, cant get anybody in to view never mind buy right now, im sure they would put any potential buyers off straight away anyway....
Im back to recording the noise on the nuisance sheets, will start recording on my phone too.

Hi Dcorless, If you sell your property with the current neighbours still living above you, You must declare the problem to them, Its best to get a solicitor to phrase the letter as they know exactly how to put it without declaring the whole sorry mess, Just enough to cover you legally. If the upstairs neighbours move out before you sell then you dont have to declare any complaints youve made..... This is the scarey part about making noise complaints when you own the property. They are proffesional people, they should be smart enough to understand what they are doing, instead of telling them what they are doing wrong, why dont you tell them what they are doing to you and how you feel.

I have been up twice to tell them how I feel, the second time I was very upset and in tears due to how noisy they were that day. He said to me he knows it is distressing me but it distresses him to tell  his daughter to stop banging and running around, and as she only wakes up about 10-11am, he cant expect her to go to bed before 11pm! They just arent normal at all, that child is allowed to do as she pleases whenever she wants. I also think they are now doing it on purpose to annoy us, she was up until after 1am last night, and they literally just let her jump around, bounce balls on our bedroom ceiling, bang on the walls/floor - there is no way there are trying to help us...

Yes, be upfront about the nusience.....it may not worry a truly noisy DJ / Drummer / etc etc.....otherwise the sooner you can get out the better....

they may move out....or they may not....can you find out....or just wait and see....

I know the landlord as he used to live there before, he was fine - great neighbour, but now he only seems to rent out to asian doctors, and we have had nothing but problems with every one of them. They seem to like lots of visitors over all the time! Its only a 2 bed flat and one weekend we counted about 15 people sleeping over... as you can imagine the noise was awful!

The landlord mentioned 2 months ago they only signed a 6 month contract (they moved in August 2011) so surely they should be out soon? Well thats if they havent signed another 6 months... He did say he would never allow children again, I think they have ruined all of his furniture that he left, so hopefully he wouldnt let them sign another one - I have pestered him enough anyway about getting them out!

I will never ever buy a flat again EVER! I dream about living in a detached house! If only...

know what you mean I regret.  Maybe renting would be a better option till your confidence returns....until then keep on at that Landlord....health and safety is being broken....by those who DO know better. See if you can confirm there gone in 15 days hmm .....that will make you feel brighter hmm

Yeah I emailed him last week asking when they are leaving, still waiting on the reply! He is probably sick of me but I dont care anymore, he doesnt have to go through what I have to so I will keep pestering until I get answers...

If I find out they are moving I think i will throw them a leaving party! smile
