Topic: Changing Legislation

I've only recently joined this forum after suffering for months with NN's, and I've found the advice and support that I've received in such a short space of time immensely helpful and comforting. It occurred to me after reading through hundreds of posts that perhaps we could try and do something about this... There must be thousands in the same situation. Does anyone have any good ideas as to something constructive that we could do as a group?

A petition to get a question asked in parliment may be a start. May be to get the legal description of "quiet enjoyment" changed.

Think all buildings should have a set level of sound proofing.  The classic phrase.... It's just living noise...is a get out for the powers that be.  Everything else in a property has to be st a certain level for safety, the same should be said for noise

I think it's possible to register a petition on a Government website... I'll investigate...
I'd also like to see quicker and harsher punishment, but need to look into this too...  smile

It's a good idea, I know the government are going to come down hard on  subletting because of a change in the law, my nn has managed to wriggle out of that one too.  I have also found that all the places you can go for help have been closed with all the cut backs and I have rung just about everyone you can think of for help

Totally agree with this.
Dawncorous- I agree, a decent level of sound proofing in every house.

Amazes me that our house is about 23 years old-you can see what was done on the cheap. Wall and loft insulation was put in as new. Decent boiler also. Yet no double glazing (not sure if new homes get this now?) and woefully thin walls!

I have been advised by a builder that alot of pre 1960 properties can't even take improvements like new bathrooms or kitchens without changing the noise level on third party walls. Just think if a basic assessment and sound proofing if needed, would save people's lives from being destroyed, stop bad neighbour relations and save the ha and council lots of money in the long run.

Trust me, sound proofing may buffer noise from raised voices or mildly loud TV but it won't even come close to quieting the BOOM BOOM BOOM of music and screams and thumps from drunken idiots.
At the weekend I heard music coming from a house 6 doors down. God help their neighbours! A  lead wall wouldn't even eliminate that kind of noise.

So what needs to change? For a start it would be nice if noise was even recognised as a problem by the authorities. Most authorities deem noise as merely a 'nuisance'.
Yes, having no sleep for 3 days running is merely a 'nuisance' isn't it?

I don't think the current system works well - letters, diary sheets, mediation, more diary sheets, more letters... maybe 2 years down the line a court date where NN get a slap on the wrist and we're back to square one.

My EH team are only open Mon - Fri, 9-5. No out of hours, no noise team to come out and witness noise - nothing. Why can't they come out, witness the noise and issue a warning? Why can't the police have the same powers they do in Scotland - where they're able to confiscate noise making equipment on the spot and detain that equipment for 28 days unless NN pays a fee? Surely this would make NN think twice before turning on the hi-fi...

Why aren't noisy neighbours simply hit with a fine each and every time someone from EH comes out and witnesses the excessive noise? Surely that would save LA's a lot of time and money?

The possibilities are endless... there has to be a better way.

the thing is, all these cut backs mean we dont have an out of hours service here. EH say they want to witness it but dont provide me with anyone to call to wtiness it. its like being on a merry go round and it never stops going around!

I don't believe its a change we need so much as enforcement of the E P Act 1990.

quiet enjoyment refers to landlord ..... not bugging us.....and NOT NN as we ALL THOUGHT hmm
