Well i got the results back from the recording equipment and it confirmed banging, thudding and voices late at night everynight but it is still not bring classed as antisocial despite this noise starts every night 11pm and goes on till the early hours.  Think i've hit a brick wall now and there is still no sign of the laminate being removed

Oh no! I sympathize I've got the same problem, but the council has to tell them there going to put a machine in. Either they are stupid or just don't care.
Mine have shut up, but it may not last. They are leaseholders. I am desperately trying to find out who owns the property, I've been to the land reg and got the title number,but they wouldn't give me the name or address anyone know how to go about getting that

My Nn are leaseholders Have been to the Land Reg got the title number but wouldn't give me the name and address of the owner.  Does anyone know how I can find that

could be the freeholder owns a "BLOCK" of properties, managed by an agent / estate agent......even the church/Queen owns MANY freeholds.....could ask your LH neighbours, chances are its the same one......

So why have the council chosen to ignore the Environmental Health Act section 80 relating to noise nusience......or even offered suggestions for removal of the laminate by the NN......ASK THEM via e-mail.......nicely of course..... hmm   or if the H Assn installed the equipment request the evidence be transferred to E H for their noise nusience team neutral

Thanks for your comments, mine is owned by housing association.  The upstairs tenant has been away for a week but came back this morning with friends so i've already had a few hours of loud voices and music.  My carer has just been and as soon as my door goes he turns everything down.  I just don't see if the recording equipment has picked up the noise how they can class it as daily living when it starts 11pm plus everynight and can go on till 3 or 4am.  My nurse has even told the h.a that eight months of this has made my medical condition unstable and the constant phone calls over it and stress hasn't helped.  Ha said my nurse should give me coping strategies.  She said she needs sleep
Also my ha said they have not got the powers to remove the laminate even though their own surveyor said it was a problem last oct.  they have asked upstairs tenant to apply for a grant but wanted to use my medical conditions.  So in one breath thry dont believe what is going on here then they want to use my personal information.

Basically, this type of grading gives the councils/associations a way of being lazy and get something for nothing.

I have just decided to put my shoulders to the wheel and get away from companies that work in such a manner. There is no words to describe how much i loathe my association , but for my own sake i am focusing on juz getting far away from them and their f$cked up way of doing things.

Just recently( i think i have mentioned this before) i came across a newspaper article in which they where sued for failing to protect two homosexuals against bullying and the director @ the time said " he will learn from it". THAT director is still in operation today havent NOT learnt a thing and his company STILL neglects tenants.

I have no idea where im going to go - but i know as far away from them and their prejudice MAD employee whose daily existant includes harassing me

Once upon a time i would of fought for the property but when you have a bunch of bigotted racists, for you own sake its best to say you know what i dont want to be a party to your mental bs! and i hope that someday you will get  it back in spades what you have dishing out for so long   smile

Hi minks,

My problem is i live in an adapted property and my family and friends live on the same street.  The ha already know that my care system would fall apart so i'm stuck.  If i had of been mobile i would have asked to be moved.

would suggest you involve organisations who specialise in your condition.....maybe their BIGGER voices can assist ????

Am looking into that thanks.  Ha are trying to say am noise intolerant because of med cond, no one could get any sleep here ill or not. I have had friends leave when they visit because you cant even watch tv in peace because upstairs is too noisy

Hi everyone,

Well got written confirmation from ha chief exec today.  Classing everything as living noise, they wont get the laminate removed or soundproof my flat and the affordable way forward is mediation.  It obviously all boils down to money.  Very fed up after three hours of non stop banging on the ceiling, loud voices and music

ahhh see my council tried mediation but nn didnt turn up and now im stuck in limbo cos they dont wanna take it to court cos of costs (they havent said this but Im not stupid) and neighbours keep pissing me off and making loads of noise. Im in hell. lottery win please!

huge hugs dawn...I think living noise is just an excuse. do your neighbours play loud music?
