Topic: How can i find out if noisy neighbours rent?

Hi,

I realise that compared to most my problems are minor - i have a group of middle aged men who smoke and chat in their garden at night, all from the same flat.  The problem is that they shout rather than talk (it almost seems like they are arguing but then they laugh) and do it several times a night between 12pm and 3am.  Then one of them gets up at 5am to cough and spit in the garden.  Sounds minor but is not a nice way to be woken!  The bedroom windows of all four flats face into the gardens and the noise just echoes up the walls and its too hot to close the windows. 

We've talked to them (as have other neighbors) and although they were nice and stopped that night, they've carried on since.  We then wrote a note but to no effect, but we aren't sure how good their English is.

I'd like to find out if they rent so we can approach their landlord but does anyone know how i can found out if they rent please?  Didn't get very far with google.

Hi Rach. If they rent, and genuinely rent - that is, not living in a place owned by a relative or friend - then the council should have a record of it, as rented places have to have fire etc certificates. However, as I've just discovered from our council's website, sometimes this type of work is farmed out to other agencies. I would suggest you contact your local council first off.

Hi Rach,

I knew my noisy neighbours were renting but I wasn't aware of who they were with.  To find out I simply called my area's big 4 letting agents and asked if they were responsible for the address in question, and I found them after a few minutes.

We have a sub-let above the flat we own, and it seems as though the rental company are renting it to a Housing Association who are using it for temporary lets (3 or 6 months).  We had massive problems before Christmas with the tenants and when we approached the Rental Company, they just made the usual noises about tenants having rights as well and not really taking our noise complaints seriously.  That tenant moved out in January and since then we have had no problems with the 2 sets of the short term tenants BUT now its all changed again.

The lad that lives in there now plays his music so loud, I can feel the bass vibrating through our sofa and can't hear the tv or each other at times.  They have been in 10 days and our life is hell again.  We have approached the tenant direct, who apologised and then 1 hour later the noise resumed and has been played at that level on and off since last Thursday.

I need to know if there is any way I can find out which Housing Association is renting the flat from the rental company, as the rental company are not bothered as they are getting paid!  Also there must be something in their rental lease with regards to noise and anti-social behaviour but how would I get a copy of that?

We even contemplated going to a hotel for a night just to get some peace and sleep for work the next day and recharging it back to the rental company.  Wonder how they would like that!  Any ideas anyone?

I've contact both the police and Environmental Health who told me my complaint would be dealt with, within 24 hours.......guess what!  Haven't heard a word from them!

It is a terrible position to be in and a crying shame that the very people who are supposed to help are shirking their duties. You are definately being fobbed off.

I would go back to the agents and quote from the following:

No need to get too involved ie who owns or who the housing association is.

Stick with the managing agents and keep at them. If need pay £50 for your solicitor to write them a letter and telling them of their obligations.

In terms of the lease agreement if you want write them a letter and make a request under the freedom of information act.

In it state:

Please confirm if your lease agreement, sub let agreement or agreements with any housing association contain a clause for anti social behaviour.

This is a request made under the freedom of information act as this information is not in the public domain. The act allows you 20 working days for the provision of this information or provide a reason for not doing so. I am of the opinion that no excemptions apply including commercial or confidentiality considerations.

I would draw your attention that should you fail to provide this information, I will refer you to the Information Commissioners Office.

All this should get them to take a little bit more notice.
